Court rules iPhone looks can’t be protected, adjusts Samsung’s $930 million penalty

Today (Monday), United States Court of Appeals for the Federal Circuit said that Samsung violated Apple’s design patents but Samsung did not contravene on Apple's trade dress property.

According to our source (Reuters), The U.S Court of Appeals has reversed Apple’s portion of $930 million verdict against Samsung, and the court has ordered that the penalty shall be adjusted.

“We therefore vacate the jury’s damages awards against the Samsung products that were found liable for trade dress dilution and remand for further proceedings consistent with this opinion,” the ruling states.

The $382 million given for trade dress will be readjusted by the lower court. When sometime later the trade dress claims are removed from the judgement, Samsung’s $930 million penalty with Apple is will be decreased.Apple literally filed four trade dress violations against Samsung.
